1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of spiritbluenotary.com (the “Site”) and the mobile notary and loan signing agent services provided by Spirit Blue Notary (“we,” “us,” or “our”). If you do not agree to these Terms, do not use the Site or our services. Our Privacy Policy and Notary Disclaimer are incorporated into these Terms by reference.
2. Nature of Our Services
We provide notarial acts authorized under California law (such as acknowledgments, jurats, and oaths/affirmations) and act as a loan signing agent for documents provided by lenders, title companies, escrow officers, or attorneys.
We are not attorneys licensed to practice law in the State of California. We cannot give legal advice, draft or select legal documents for you, explain the legal effect of a document, or advise you on immigration or other legal matters. If you have legal questions, please consult a licensed attorney.
A notarization verifies the identity of the signer and that the signer appeared before the notary. It does not verify the truthfulness, accuracy, legality, or validity of the contents of any document.
3. Booking Requests and Appointments
Submitting a booking request through the Site is a request only and does not guarantee an appointment. An appointment is confirmed only when we contact you to confirm the date, time, location, and fees. We reserve the right to decline any booking request.
You agree to provide accurate and complete information, including the type and number of documents, number of signers, and meeting location, so that we can quote accurate fees and arrive prepared.
4. Signer Requirements
Every signer must, at the time of the appointment:
- Appear in person and present valid, current, government-issued photo identification that satisfies California Civil Code § 1185 (or be identified by credible witnesses as permitted by law).
- Be willing to sign, aware of what they are signing, and able to communicate directly with the notary.
- Sign the notary journal and, where required by California Government Code § 8206, provide a right thumbprint.
- Bring complete documents. Blank spaces must be filled in or crossed out before notarization.
5. Right to Refuse Service
The notary may refuse or stop a notarization, without liability, if the signer cannot be satisfactorily identified; appears to lack understanding of the document; appears to be acting under duress or coercion; if the document is incomplete; if the notary has a conflict of interest; or if the notary believes the act would be unlawful, improper, or fraudulent. Travel and appointment fees may still apply in these situations.
6. Fees and Payment
Notarial fees are charged in accordance with California Government Code § 8211, which sets the maximum fee per signature for acknowledgments and jurats. Travel, convenience, after-hours, waiting-time, printing, and loan signing package fees are separate from the state-regulated notarial fee and will be disclosed and agreed upon before your appointment. Prices shown on the Site are estimates and may vary depending on location, timing, and the number of documents and signers.
Payment is due at the time of service unless otherwise agreed in writing.
7. Cancellations, Rescheduling, and Late Arrivals
Please notify us as early as possible if you need to cancel or reschedule. Cancellations made after we have departed for your appointment, or a signer who is not present or not ready at the scheduled time, may be subject to a trip or cancellation fee, which will be disclosed when your appointment is confirmed. Extended waiting time may incur additional charges.
8. Customer Responsibilities
You are solely responsible for the content, accuracy, and legal sufficiency of your documents, for selecting the correct type of notarial certificate where you are able to do so, and for recording, filing, or delivering documents after notarization. We are not responsible for the rejection of documents by any third party for reasons outside the notarial act.
